This website provides general information on a class action lawsuit pending in the United States District Court, Southern District of New York, In Re Natural Gas Commodity Litigation, Master File No. 03 CV 6186 (VM) and on the second group of settlements that affects the rights of all persons who purchased, sold, settled or otherwise traded New York Mercantile Exchange (“NYMEX”) Natural Gas contracts between June 1, 1999 and December 31, 2002 (the “Class Period”) in that lawsuit against the following Remaining Settlement Defendants:
American Electric Power Co., Inc. and AEP Energy Services, Inc.; Aquila Energy Marketing Corp. and Aquila Merchant Services, Inc.; Coral Energy Resources, LP; Dominion Resources, Inc.; and El Paso Marketing, L.P. (formerly known as El Paso Merchant Energy, L.P.) (“REMAINING SETTLING DEFENDANTS”).

This action alleges that the Defendants manipulated the prices of NYMEX natural gas futures and options contracts during the Class Period by allegedly reporting inaccurate, misleading and false trading information to trade publications. The Defendants have denied the allegations and deny any and all liability to the Plaintiff and the Class, but the Remaining Settling Defendants have agreed to settlements totaling $28,087,500.
A hearing was held on June 15, 2007, at 10 a.m. before the Honorable Victor Marrero in Courtroom 20B, United States District Courthouse, New York, New York to consider the fairness, reasonableness, and adequacy of the proposed settlements with the Remaining Settling Defendants. The Settlements were approved.
Class Members have the right to submit a Proof of Claim (see link at right) if they want to be considered for a payment. If you want to be considered for a payment, you must submit a properly completed Proof of Claim and it must be mailed to the Settlement Administrator at the address listed in the Notice with a postmark date of on or before August 17, 2007.
Class Members also have the right to file an objection to the settlements. To object to the settlements and to appear at the hearing, you must file a written objection as described in the Notice Packet to be RECEIVED by Court and Counsel on or before June 4, 2007.
Class members also have the right to exclude themselves from the Class. If you choose to exclude yourself from the Class, you must mail a written exclusion containing specific information as described in the Notice and it must be RECEIVED on or before May 29, 2007.
